NETRIGHT condemns flogging of “sex tape” lovers in Wa

The Network for Women’s Rights in Ghana (NETRIGHT) has condemned the flogging of suspects in ”sex tape” saga in Wa in the Upper West Region.

A tricycle driver and a ticket seller at the Wa Central Market in the Upper West Region received 20 lashes each after their sex tape leaked on Social media.

The two were flogged after the Overlord of the Waala Traditional Area, Wa-Naa Fuseini Seidu Pelpuo IV allegedly ordered their caning by some youth in Wa.

According to reports, the lady in question uploaded the sex video on social media on Sunday, May 29, 2022.

The Waala Traditional Area constituted a by-law in late 2021, banning such practices after it was observed that leaked sex tapes were on the surge amongst the youth in the Wa municipality.

The Overlord of the Waala Traditional Area has warned that anyone who leaks their sex tape or nude photos will face the Bye-laws of the Traditional Area.

In a statement, NETRIGHT has condemned the “barbaric” act in no uncertain terms on the grounds that it is a gross violation of the human rights of the persons involved.

According to the statement, the act is an infringement on their rights to dignity and demands that the perpetrators of this heinous act be made to face the full rigour of the law.

NETRIGHT has also called for the perpetrators of the crime and any that aided and abetted the criminal and unconstitutional act to be brought to justice.

STATEMENT ON YOUNG PERSONS FLOGGED AT WA NAA’s PALACE

The Network for Women’s Rights in Ghana (NETRIGHT) has taken note of the Graphic Online report on Tuesday, 31st May 2022 of two young persons whose sex video had been leaked on social media had been ‘picked up by some residents and flogged publicly in Wa’. According to the article the two were ‘paraded at the forecourt of the Wa Naa’s palace …and lashed by a group’.

NETRIGHT condemns this barbaric act in no uncertain terms on the grounds that it is a gross violation of the human rights of the persons involved and an infringement on their rights to dignity and demands that the perpetrators of this heinous act be made to face the full rigour of the law.

Ghana is a democracy governed by the 1992 Constitution of Ghana which supersedes religious and traditional laws including customs and practices in the country. Chapter 5 of the Constitution clearly spells out the human rights of every citizen of Ghana.

The despicable act of the group in Wa violates Article 15 (1) and (2)(a) of the 1992 Constitution which states categorically that ‘[T]he dignity of persons shall be inviolable’ and that ‘[N]o person shall… be subjected to torture or other cruel and degrading treatment or punishment’.

It behoves everyone who holds allegiance to Ghana to ensure that we, in no way condone barbaric acts of this nature that could very easily destroy our nation, by enabling hoodlums and their sponsors who hide behind religion and tradition to perpetrate heinous crimes. The perpetrators in this case must be made an example of to send the message across clearly that no individual or group of persons in Ghana have the right to inflict punishment on others without recourse to the law and in accordance with the respect of the human rights of every Ghanaian enshrined in the Constitution.

We take note of the latest development regarding the Police invitation of the Wa sub-chiefs and will be following the matter closely. We call on the Inspector General of Police, George Akufo Dampare to ensure that the Police investigate fully and prosecute the offenders. There have been instances where the Police have indicated their investigations of similar cases of instant justice but have failed to prosecute the matter to its end.

The perpetrators of this odious crime and any that aided and abetted the criminal and unconstitutional act, no matter their status in the community, must be brought to justice.

We cannot accept this barbarism! Not now, not ever!
