Election Petition: Mahama's application to inspect EC’s documents dismissed

President Mahama’s application to inspect some original documents of the Electoral Commission (EC) has been dismissed by the Supreme Court.

The  petitioner in the 2020 presidential election petition, filed an application which was asking the court to order the Electoral Commission to allow him to inspect some original documents.

Lawyer for the petitioner Tsatsu Tsikata argued that “These are plain circumstances which necessitates a reference back to the original documents which are in the custody of the first respondent (EC) so that there could be a proper validation of what the correct figure is.”

Dismissing the case, the seven-member panel of the court, presided over by Chief Justice, Justice Kwasi Anin Yeboah, said the petitioner, former President John Dramani Mahama has failed to demonstrate to the court that he has no records of the said documents.

The election petition comes after the NDC argued that the New Patriotic Party’s (NPP) flagbearer, Nana Addo Dankwa Akufo-Addo, did not win the election 2020 as declared by the Electoral Commission (EC).
