Former Member of Parliament for Tamale Central, Inusah Fuseini, has come to the defence of former Chief Justice of the Supreme Court, Justice William Atuguba, over comments made against the Apex Court.
Former Justice of the Supreme Court, Justice William Atuguba, has criticised the decision by Supreme Court which nullified the election of James Gyakye Quayson as the MP for Assin North in 2020.
Delivering a speech at a public lecture organised by Solidare Ghana in collaboration with the University of Ghana on the theme: protecting our democracy; the role of the judiciary at the political science department, on Thursday, October 24, 2023, Justice Atuguba claimed that some judges who politically inclined are on the panel on certain cases that are political in nature.
He said what was supposed to have been done was the execution of the High Court’s decision and not a fresh matter at the Supreme Court
“The decision of the Gyakye Quayson case was scandalous. The Supreme Court re-adjudicated the matter already decided by the High Court. The Supreme Court does not stand in good light despite the clear renunciation in November 2020 whereas the election was in December, I am not able to see substantial justice in this,” Justice Atuguba said.

Commenting on the issue on Atinka FM’s AM Drive with host, Nana Fianko, Former Member of Parliament for Tamale Central said persons who are honest and dispassionate will come to the same conclusion as justice Atuguba.
The former lawmaker reiterated that at a point in the trial of James Gyakye Quayson, he was of the view that the Supreme Court was delivering jurisprudence of convenience.
“I believe that all persons who are honest, dispassionate, take responsibility, speak the truth will come to the same conclusion that Justice Atuguba arrived. At a point I remember asking the kind of jurisprudence they were using to determine Gyakye Quayson’s case. If you look at the constitutional provision, it says that one is disqualified from parliament if he or she holds allegiance to another country, simply put you cannot be in Parliament if you’re holding allegiance to another country. On the 7th of January 2021 he was not you’re holding allegiance to any country… that is why it is scandalous,” he added.
