Speaking on The Big Issue on Saturday, September 5, Mr Domelevo urged public officials, particularly those occupying sensitive constitutional positions, to be mindful of how their statements could be interpreted.
“My wish is that if it is possible, the Chief Justice should stop commenting on some political issues, especially issues that can later on cover litigation coming back to the court,” he said.
Mr Domelevo explained that public comments describing an institution as corrupt or inefficient could become problematic if disputes involving that institution later come before the Judiciary.
“If you already make it known that this institution is corrupt or inefficient or has so and so, one may think that you are already prejudiced,” he said.
His comments follow remarks made by the Chief Justice during recent visits to public institutions, where he praised the performance of some state-owned entities under the current administration while questioning what had been achieved over the previous eight years.
Mr Domelevo acknowledged that the Chief Justice’s intentions may have been positive but urged him to exercise greater caution when commenting publicly on politically sensitive matters.
He said doing so would help protect both the actual and perceived independence and impartiality of the Judiciary
