Address lapses in guidelines – 6 NDC presidential aspirants appeal to NEC

Six presidential aspirants of the opposition National Democratic Congress (NDC) have commended the National Election Committee (NEC) of the party for taking the pain to produce the guidelines for the conduct of the party’s presidential election.

They, however, maintained that the guidelines contained some lapses that needed to be addressed as a matter of urgency.

They further called for due diligence to be done to address the lapses in the operation guidelines that had been developed to be used to conduct the party’s upcoming presidential primaries.

A letter dated February 10, 2019 and signed by Dr Yaw Ato, on behalf of the Aspirants Technical Committee, called for all lapses in the guidelines to be addressed to ensure that the electoral process was free and fair.

Six aspirants

The six aspirants are Mr Alban Bagbin, Professor Joshua Alabi, Mr Sylvester Mensah, Mr Augustus Tanoh, Mr Ekwow Spio-Garbrah and Mr Nurudeen Iddrisu.

Former President John Dramani Mahama is the seventh candidate but is not part of the six petitioners.

One of the issues pointed out by the six aspirants was that the guidelines had not provided adequate description of electoral processes to be carried out and monitored by agents.

They also added that the guidelines did not state the rights and obligations of various stakeholders, including agents, Electoral Commission (EC), Elections Committee and other party officials clearly.

Also, they argued that the document did not provide standards to which the Elections Committee was committed and the complaints and redress mechanisms available to aspirants.

Among the other grievances raised by the aspirants are that “no notice of polls has been issued two weeks to the election, and aspirants were not invited to oversee printing or distribution of notices, meaning that the EC is in breach of its guidelines”.

They also raised concerns that there were issues about the electoral college, voting modalities and ballot box printing that ought to be addressed immediately to forestall the integrity of the electoral process.

Engagement

The letter which was addressed to the Chairman of the party’s NEC, Mr Kofi Attoh, indicated that the candidates were prepared to discuss the outstanding issues with the Election Committee.

“While we appreciate the effort made by the Election Committee to produce the document, we do think that the operational guidelines could be improved significantly if they are to support a free and fair electoral process.

“We have attached comments for your consideration. We are available to discuss these at the meeting proposed for Tuesday, February 12, 2019. We are also available to contribute to the drafting of amendments if this is acceptable,” the letter stated.

Background

Representatives of the six presidential aspirants served a warning to the top brass of the party of an imminent “chaotic” and “controversial” election that might lead to disruptions in the electoral calendar of the party.

According to the representatives of the six, who are part of a joint technical committee, despite a series of engagements and repeated assurances of good faith from the leadership of the party, much was not being achieved with regard to making sufficient progress towards a free and fair poll.

A letter signed by three representatives of the six aspirants, Dr Yaw Akoto, Abdul-Nasser Alidu and Victor Kwadjoga Adawusu, dated February 5, 2019 and copied to the Chairman of the Elections Committee of the NDC, Mr Kofi Attoh, said “issues are not being adequately discussed and conclusions documented. Electoral processes are not following logical progression”.

The letter was equally copied to the General Secretary of the party, Mr Johnson Asiedu Nketia; the Chairman, Mr Samuel Ofosu-Ampofo, as well as the Chairman of the Council of Elders of the party, former President Jerry John Rawlings.

At least 17 people, including a child, have died in a fire that broke out early Tuesday morning in a hotel in India's capital, Delhi, police said.

A video of the incident shows people jumping from the fourth floor after breaking open window panes.

Officials said 35 people were rescued. Some of them who were injured have been taken to hospital.

Hotel Arpit Palace is located in Karol Bagh, an area popular with tourists for its budget hotels and shopping.

"There was wooden panelling in the corridor because of which people couldn't use the corridors to leave the hotel," Vipin Kenta, a fireman, told the Hindustan Times newspaper. He added that at least two people jumped out of the building.

He said they were still investigating what caused the fire. Local media reported that most of the deaths were caused by suffocation.Fire accidents are not uncommon in Indian cities where builders often flout safety regulations.

Many structures, both old and new, do not have proper fire exits. In recent months, officials have shut down a number of shops and restaurants in some of Delhi's most exclusive neighbourhoods for not following fire safety measures.

Owners of commercial buildings have also been known to construct additional floors without the necessary permissions.

Even in the case of Arpit Palace Hotel, Delhi minister Satyendra Jain told the NDTV news website that the hotel had built a fifth floor with a kitchen and a terrace, even though the owners only had permission to build four storeys.

Re: GHC54m judgement debt hits Ghana Railways

The attention of Ghana Railway Company Limited (GRCL) has been drawn to a publication on Atinkaonline.com dated 8th February, 2019 which was subsequently picked and published by Ghanaweb on 9th February, 2019 that GRCL is on the verge of losing some of its properties in Sekondi after a High Court in Sekondi hit it with a Gh¢54 million judgment debt.

GRCL wishes to clarify issues in the said publication and explains as follows:

In 2006, Management of GRCL decided to downsize its workforce due to increasing wage bill and other overhead cost and then adopted certain pragmatic steps which included early retirement of staff between the ages of 57 and 60 years to save the company from collapsing.

Management convened a Standing Joint Negotiating Committee (SJNC) meeting comprising GRCL Management, Railway Workers Union, Railway Enginemen Union of the Trade Union Congress (TUC) and agreed on terms and conditions for the retirement emolument and fringe benefit for those who would be affected by the retrenchment and retirement exercises.

The severance package which was negotiated had been paid since 2nd February, 2010.

The retrenched staff dissatisfied with the severance package filed a motion at the High Court in Sekondi against GRCL seeking severance package based on the Collective Bargaining Agreement and the Condition of Service for Senior Officers of the affected staff.

After several sittings, judgment was finally given on 7th December, 2015 by His Lordship Peter Kwabena Ababio. The learned Judge concluded that what was to be paid to the 674 affected staff must be a computation based on the Collective Bargaining Agreement and the conditions of

service of the Senior Staff Association less what had already been paid to the plaintiffs as their retrenchment or severance benefit and should attract interest at the bank rate from 2nd February to the date of judgment for the delay in the payment by Management of GRCL.

The learned judge also ordered that the affected staff still in occupation of the GRCL quarters/bungalows vacate the premises within three (3) months from the date of the judgment.

Currently, GRCL is contesting this judgment at the Appeals Court. Besides, most of the retrenched workers are still occupying the quarters/bungalows of GRCL all these years without paying rent and mesne profits. Parties therefore, need to reconcile to arrive at the final rights and liabilities of each other.

Meanwhile, there is an application to set aside the writ of Fi fa and for Stay of Execution before the High Court, Sekondi.
