The court deals with evidence, not the “truth” – Special Prosecutor

Special Prosecutor, Kissi Agyabeng has made some interesting statements with regards to court proceedings.

According to him, many people believe that, the court is a place where truth is wholly unraveled but surprisingly that is not the case, the court deals with evidence that is presented before the Judge who adjudicates cases.

He disclosed that, a lawyer goes to court with evidence that is given to him/her by his client but doesn’t have any idea about the truth, thus because of his substantial evidence and experiences, he ends up winning his case.

Speaking in an interview with Kwame Sefa Kayi on Peace FM’s morning show “Kokrokoo” Lawyer Adjabeng stressed that its only God who can determine whether a case is true or not the court.

“When you go to court, the lawyer doesn’t know the truth, the Judge also doesn’t know the truth, hence the truth resides between you and God; The exact thing you did is not known to the lawyer because he wasn’t there so he speaks to the documents and what you have told him. Therefore, if you are telling lies the lawyer is not aware; so, if the lawyer doesn’t even know the truth, how will the Judge know? The case is ruled according to concrete evidence placed before the judge.

“It can happen that you are really telling the truth, but because you don’t have evidence to back your statement, it will sound like a deception to them. That’s why I’m saying that when it comes to law, it’s evidence we are looking for and not the truth, because no one knows the truth”, he said.
